These Terms of Service ("Terms") govern access to and use of the Gismap platform. By creating an account or using the platform, you agree to these Terms.
If a customer enters into a separate written agreement with Gismap ApS, that agreement shall prevail in the event of any conflict with these Terms.

The platform integrates geospatial information from public sources and uses artificial intelligence and automated models to generate analytical outputs.
The platform is intended as a technical analysis and visualization tool only. It does not constitute professional advice, including but not limited to ecological, engineering, environmental, legal, regulatory, planning, or consulting advice.
Users must create an account to access the platform. Users agree to:

Organizations may create multiple users with roles such as administrators, editors, and viewers. Users may also be invited to collaborate across organizations and locations within the platform.
Gismap may offer a limited free version of the platform ("freemium"). Freemium users may have access to certain functionality including:
Freemium functionality may be limited, including but not limited to number of locations, available tools, and analytical capabilities.
Gismap reserves the right at any time to modify freemium functionality, limit usage, or discontinue freemium access entirely, without prior notice.
Extended functionality may be provided through paid subscriptions. Paid services are typically governed by a separate written agreement between the customer and Gismap. Such agreements may define pricing, subscription duration, usage limits, number of users, and platform functionality.
Users may only use the platform for lawful purposes. Users may not:
Gismap reserves the right to suspend or terminate accounts that violate these Terms.
Users retain ownership of data uploaded to the platform and data generated within their projects. By using the platform, users grant Gismap a perpetual right to use such data for purposes including:
Where possible, data used for these purposes will be anonymized, pseudonymized, or aggregated.
If users mark data as confidential, Gismap will not publicly disclose such data or share it externally without consent. However, this does not restrict Gismap from using such data internally for analytics, model training, benchmarking, or platform improvement.
The platform integrates data from public and third-party sources including environmental and geospatial databases. Gismap does not guarantee the accuracy, completeness, or availability of such external data sources and is not responsible for errors or interruptions originating from them.
The platform uses automated algorithms and artificial intelligence to generate analytical outputs. Such outputs may contain uncertainties or inaccuracies. All outputs should be considered informational and analytical support only.
The platform does not provide professional consulting, ecological assessments, engineering advice, or regulatory guidance. Users remain solely responsible for validating outputs before using them in planning, reporting, decision-making, or other professional contexts.
The platform is provided "as is" and "as available". To the maximum extent permitted by law, Gismap disclaims all warranties, including but not limited to accuracy of data, reliability of outputs, uninterrupted availability, and suitability for specific purposes.
To the maximum extent permitted by law, Gismap shall not be liable for indirect damages, loss of profits, loss of data, business interruption, third-party claims, or decisions made based on platform outputs. Gismap shall also not be liable for claims brought by third parties arising from the user's use of the platform or reliance on outputs generated by the platform.
For services provided free of charge (freemium), Gismap shall have no liability whatsoever. For paid services, Gismap's total liability shall not exceed the total fees paid by the customer to Gismap during the 12 months preceding the event giving rise to the claim.
Gismap aims to maintain reliable platform availability but does not guarantee uninterrupted access. The platform depends on third-party infrastructure and external data providers. Gismap may at any time modify, update, improve, or remove features or functionality.
Users may terminate their account at any time. Gismap may suspend or terminate accounts if these Terms are violated, misuse occurs, or security concerns arise. Upon termination, users may request export of their data in a commonly used format.
Gismap may update these Terms from time to time. Users will be notified of significant changes through the platform or by email. Continued use of the platform constitutes acceptance of updated Terms.
These Terms are governed by Danish law. Any disputes shall be resolved by the Copenhagen City Court (Københavns Byret).
